10. | Application for Transfer Certificate | An application for a Transfer Certificate must be made to the Headmaster/Headmistress by the parent or guardian of a pupil in person or in writing one month ahead of the date from which he wants to leave the school. In the case of a school which has ceased to exist, the parent or guardian should apply to the District Education Officer/Inspectors of Schools concerned through the Headmaster/ Headmistress of the school to which transfer is sought for sanction of the admission to that school and the District Education Officer/ Inspectress of Schools will be competent to sanction the admission. | Note - No fees should be charged for the grant of a Transfer Certificate if the application for it is made within the period prescribed in this regulation. When, however, this period is exceeded, a fee shall be charged. In case of loss of a Transfer Certificate a duplicate copy may issue on payment of a fee fixed for the purpose. The Headmaster/ Headmistress receiving such a duplicate copy will make such enquiries as are possible to find out where the holder has been during the time which has elapsed between the date of withdrawal from his previous school and the date of Issue of the duplicate copy. Such duplicate copies should be clearly superscribed "duplicate". |

11. | Grant, of Transfer Certificate |
(i) | The authority to whom a proper application for a Transfer certificate is addressed will grant the certificate within 7 (seven) days or if he/she thinks to withhold the certificate, he/she must state in writing the reasons for his/her refusal to the applicant. Copies of all Transfer Certificates issued must be kept in the school records. | (ii) | While issuing the transfer certificate to a student the following remarks should be added therein - | (a) | Whether the student failed to pass Board's Examination for two consecutive years. | (b) | The period upto, which the school is recognized. |

12. | Reasons for which Transfer Certificates may be withheld | A Transfer Certificate for which proper application has been made can be withheld only for the following reasons - | (i) | If the pupil is leaving the school for disciplinary reasons, i.e. owing to rustication or expulsion or in order to avoid punishment. | (ii) | If the school fees or other dues of the pupil are not fully paid. |
| | Note 1: In the case of (i) above, no Transfer Certificate should be issued to a pupil against whom a rustication order is operative until after expiry of that order, but in such case the penalty prescribed in the note to regulation 10 shall not be imposed. | | Note 2: In the case of (ii) above, if the dues are paid within 3 months of the pupils withdrawal, the Transfer Certificate should be granted. If the dues are paid after three months an additional fee should be levied before Transfer Certificate is granted. | | Note 3: When the pupil has held a fee remission under express stipulation in writing signed by the pupil and his/her parent or guardian to make refund in case of withdrawal from the school of amounts drawn by or remitted to, him/her, the Transfer Certificate should be withheld, until the sums due under the said stipulation been repaid provided the Transfer Certificate shall not be withheld if the subject or Group of subjects intended to be offered by the applicant has not been introduced in the school. | In case of the Transfer of the parent or guardian of the pupil from the station where the school is situated the Headmaster/Headmistress may, however, at his/her discretion waive the amount. |

13. | Appeal against the refusal to Transfer Certificate | If a Transfer Certificate is refused, an appeal shall lie with the Board of Intermediate and Secondary Education, Dhaka and the decision of the Board thereon shall be final. |

14. | Fees | (i) | A pupil on first admission into a Secondary School shall be charged an admission fee equivalent to the monthly tuition fee of the class to which he/she is admitted. Besides admission fee he/she must pay tuition fee from the beginning of the academic year in which he/she is admitted. An admission fee of the same amount shall be charged when a pupil is admitted on transfer. He/she shall also be required to pay tuition fee for the month in which he/she is admitted, but if he/she has already paid such fee in his/her former school, he/she shall not be required to pay it again. Holders of Government Scholarships are also required to pay the same admission fee as other pupils. | (ii) | If a pupil applies for readmission after his name has. been struck off the rolls, a readmission fee shall be paid equal to that of tuition fee leviable for the period of absence plus any other dues which might be payable had he/she been a student, plus all arrear and additional fees as otherwise provided in the regulations. |
| Pupils of classes IX and X who temporarily suspend their studies and withdraw their names with proper permission on account of ill-health or other sufficient reasons and seek readmission in the following year and the break of study does not exceed one year, shall on readmission, be exempted from such payment. The decision as to whether the reason is sufficient or not shall rest with the Headmaster/Headmistress. If the period of such suspension of studies in more than one year, permission of the Board of Intermediate and Secondary Education, Dhaka, will be needed. On their readmission they shall be required to pay an admission fee as under regulation 14 (i). |

15. | Tution and Other Fees | (i) | Tuition fees and other dues shall be charged from the students for the whole year whether a pupil attends classes for the full twelve months or not. In the case of student seeking admission with a Transfer Certificate tuition fees and other dues should not be charged for the month for which such dues have already been paid in the former school. | (ii) | Tuition fees are payable in monthly installments, and a full month's installment shall be charged whether a pupil is in an institution for the whole or part of a calendar month. | (iii) | A pupil who leaves one recognized school to join another within the same school year shall be required to pay the tuition fees and other dues for the period intervening between the date on which he left his former school and the date on which he joins his new school. | (iv) | When, however, a pupil leaves a recognized School within one school year and joins another in the following year or any subsequent year, the penalty prescribed in clause (iii) above shall not be enforced. He shall only be required to pay fees and other dues from the beginning of the school year in which he joins the latter school. | | Note - A receipt should be given to each pupil for any Payment made by him | (v) | year and joins another in the following year or any subsequent year, the penalty prescribed in clause (iii) above shall not be enforced. 16. | Dates of payment | Tuition fees and other dues are payable in advance on either of the two dates to be fixed up by Headmaster/Headmistress within the 15th day of each month, or if the school is not open on that day, the day on which it re-opens. | Provided that all dues shall be collected by the 15th of each month. If the first fifteen days of any month fall within a vacation, the dues for that month must be paid at the same time as the dues for the previous month. |

17. | Penalties for non-payment of fees due | (i) | A fine of fifty paisa will be levied if any monthly tuition fee is outstanding in full or in part after the 15th of each month. If any dues including fines be not paid on or before the first working day of the next month, the pupils name shall be removed from the register on that day. | (ii) | The application of a student for permission to appear at the examination of the Board shall not be forwarded to the Controller of Examinations until he/she has paid all sums due to the school in which he/she has been reading including tuition fees up to the end of the month in which the Secondary School Certificate Examination held. |

18. | Refund on transfer of amount of free-studentship enjoyed | When a free studentship is granted or fees are remitted to a pupil he/her parent or guardian, to the effect that if he/she leaves the school within a stated period, he/she shall refund the amount drawn by or remitted to him/her during the school year in which he/she leaves. |

19 | (i) | The following cases of admission and readmission of students of Classes IX and X and of students who fail to pass or appear at the examination (regular or compartmental) of the Board shall be reported in the prescribed form to the Board of Intermediate and Secondary Education, Dhaka for its sanction - | (a) | Re-admission into the same school after three months from the date on which the name of the student was struck off the rolls; | (b) | Admission of students on transfer from another school after one month from the date of leaving the former school; | (c) | Admission of plucked students after one month from the date of publication of the results of the Board's examination (regular or compartmental) (in the case of students who failed to pass the said examination); | (d) | Admission after one month from the date of conclusion of the examinations (regular or compart mental) of the Board (in the case of students who failed to appear at the said examinations). | (e) | Break of Study - Cases of admission under 19 (i) (a) (b) (c) or (d) above shall be accompanied by a condonation fee. Case of break of study for more than one year shall be accompanied by a special Condonation fee. |
| (ii) | Before reporting the cases of admission and readmission under regulation 19 (i) above, the Headmaster/Headmistress shall first obtain the following papers and documents from the students concerned, shall scrutinize and verify them to his/her entire satisfaction about their genuineness and keep them in the school records always ready for submission to the Board when called for- | (a) | Application from parent or guardian addressed to the Headmaster/ Headmistress of the school into which admission is sought. | (b) | A certificate from a Gazetted Officer or the Chairman of a Union Council with his full designation or under his official seal to the effect that the student did not read in any school (recognized 'or unrecognized) within or outside the territorial jurisdiction of the Board during the period of break of study mentioned by the guardian if the break of study exceeds one year. | (c) | Medical Certificate from a Registered Medical Practitioner on his personal note paper if the break of study is due to illness and the applicant is now fit to resume studies. | (d) | Transfer Certificate in original from the former school (in the case of admission on transfer from another school). | (e) | Admit Card in original for the Board's 152 Examination in which the student last appeared (in the case of admission of students who failed to pass or to appear at the Board's Examinations). |

| | Note - No admission on transfer From another school shall be allowed without obtaining Transfer Certificate from the former school and no transfer Certificate of students coming from unrecognized High Schools shall be entertained without the counter-signature of the District Education Officer of the area concerned. Applications for condonation of break of studies of students of Class IX and X must not in any case be forwarded to the Board after 1st November. | (iii) | Admission on migration from other Boards or Universities - Cases of admission on migration from other Boards or Universities shall be reported to the Board along with the following documents and requisite fees for its sanction: | (a) | Migration Certificate from the former Board or University. | (b) | Transfer Certificate in original countersigned by the Inspecting Officer of the Place where the student was attending school formerly (in case no migration certificate is issued by the Board or University under which the student was attending a school). | Note - Cases of admission of students coming from outside the jurisdiction of the Board, where there Is system of counter-signature by the Inspecting Officer, should be referred to the Board by the Headmaster/Headmistress of the school to which admission is sought | (c) | Admit Card in original if the student appeared at any public examination held by other Boards or Universities. |

| (iv) | For the sake of saving time the Headmaster/Headmistress, on receipt of fees and necessary documents to his/her entire satisfaction as required under these regulations, may make admission under regulation 19 (i) provisionally subject to the sanction of the Board. | Note - The Headmaster / Headmistress shall be held wholly responsible for any Irregularity In admission if and when detected. He/she shall also be held entirely responsible for all the entries In the statement form on the basis of which the admission may be sanctioned by the Board. |
| (v) | The Board will consider condonation of the period of break of studies on the recommendation of the Headmaster/ Headmistress who will assure holding of extra classes where necessary for making up the shortage of schooling up to the required standard resulted by the break of study. |

20. | False documents | If a pupil is found to have produced a false or tampered document or documents containing any erasure or to have made a false statement as to his attendance in any school, shall be reported to the Board of Intermediate and Secondary Education, Dhaka, which shall award such punishments as it deems fit, including fine, rustication or expulsion. |
|
21. | Disputes | All questions arising with regard to the interpretation of these regulations shall be referred to the Chairman, Board of Intermediate and Secondary Education, Dhaka, who may take such decision as he deems fit. | His decision in such matters shall be final subject to report to the Board. |
|
22. | Fee mentioned under different clauses of these regulations shall be fixed by the Board. |
23. | These regulations replace all previous orders, rules and regulations regarding the conditions favoring admission of students to and transfer of students from Secondary Schools. |
